How Are Disability Attorneys / Representatives
Paid?
Social Security Disability attorneys and non-attorney
representatives will generally handle your claim on a contingency fee basis. This means that there will be no
fee if they are not successful in helping you get a favorable decision on your claim.
Attorneys are allowed by law to charge no more than $6000, or
to collect 25% of your past-due or retroactive benefits, whichever is less.
Though there is no fee if you lose your appeal, there may be
expenses that the attorney or representative incurs in the process of preparing your claim for appeal. These
expenses may include payments made to your doctors/hospitals to obtain your medical records, or other
miscellaneous charges such as copying papers.
Still, these charges generally do not exceed $150 to $225, and may be paid
when your claim is closed.
